Terms of service

1. Agreement

These terms form an agreement between EduGate Cloud ("EduGate Cloud", "we") and the school or school group that subscribes to EduGate Cloud ("the School", "you"). By starting a trial, signing an order form or using EduGate Cloud, you agree to these terms. If an order form signed by both parties says something different, the order form wins.

2. The service

EduGate Cloud provides the school office (web), the EduGate Cloud Parent, Teacher and Driver apps, messaging tools and the modules included in your plan. We may improve or change features over time, but we will not remove a core feature you are paying for during your billing period without offering a fair alternative or refund.

3. Free trial

Trials last 14 days and include the features of the plan you choose. At the end of the trial you can subscribe or stop; if you stop, trial data is deleted after 30 days.

4. Accounts and access

• The School decides who gets access and what each role can see, and is responsible for activity under its users' accounts.
• Logins are personal. Staff must not share passwords, and the School should remove access promptly when someone leaves.
• Parent, teacher and driver accounts are created by the School; EduGate Cloud does not sell accounts to individuals.

5. School responsibilities

• Make sure you are allowed to add the information you put into EduGate Cloud, including telling parents and staff how their information is used.
• Get any consent needed for photos, messaging and location features.
• Keep the information accurate and follow our acceptable use policy.

6. Fees and payment

• Fees are charged per active, enrolled student per month at the rate in your quote or order form, plus any add-ons you choose.
• We invoice monthly or yearly in advance. Invoices are due within 15 days.
• We count active students on the 1st of each month. New students added mid-month are billed from the next month.
• If an invoice is more than 30 days overdue, we will remind you in writing; if it remains unpaid 15 days after that reminder, we may restrict access to the school office until payment is made. Parent alerts for safety (such as bus and attendance) stay on during this period.
• Prices are fixed for your current term. We will give at least 60 days' notice of any price change at renewal.

Cancellations and refunds are covered by our refund & cancellation policy.

7. Your data

The School owns all data it adds to EduGate Cloud. We use it only to provide the service, as described in our privacy policy. You can export your data at any time in standard formats (Excel/CSV and PDF).

8. Our property

EduGate Cloud's software, apps, designs, logo and name belong to us. Your subscription gives you a right to use EduGate Cloud for running your school; it does not transfer ownership. If you choose branded apps, your school's logo and name remain yours.

9. Availability and support

We aim to keep EduGate Cloud available around the clock and schedule maintenance outside school hours where possible, with advance notice for planned downtime. Support is available Mon–Sat, 9am–6pm (Pakistan time) by phone, WhatsApp and email, depending on your plan.

10. Confidentiality

Both parties will keep the other's confidential information private and use it only for this agreement.

11. Ending the agreement

• You can cancel at the end of any billing period as described in the refund & cancellation policy.
• Either party may end the agreement if the other seriously breaches these terms and does not fix the breach within 30 days of written notice.
• After cancellation you can export your data for 90 days, after which it is deleted.

12. Liability

We will provide EduGate Cloud with reasonable care and skill. Except where the law does not allow it, neither party is liable for indirect or consequential losses, and each party's total liability under this agreement is limited to the fees paid by the School in the 12 months before the claim.

13. Changes to these terms

We may update these terms. We will give schools at least 30 days' notice of material changes by email and in the school office.

14. Governing law

These terms are governed by the laws of Pakistan. Disputes will first be discussed in good faith; if unresolved, they will be settled by the courts of Pakistan.
